(RSC 2013.2) Mandatory Minimum Sentencing

To date, there is no legislation specific to mandatory minimum sentencing.  However, HB 473 Truth in Sentencing Task Force (Simmons and Kramer) creates a task force that could potentially address that issue.  It would be charged with examining state laws relating to sentencing, the diminution of sentences (early release), and parole.

Almost 300 bills relating to sentencing and penalties have now been filed, five of which relate to topics covered in this RSC under drugs. The bills which would allow for medical marijuana as well as the “de minimus” bills would reduce or eliminate penalties for possession and use of marijuana.

MANDATORY MINIMUM SENTENCING
 
Legislation which would repeal mandatory minimum sentencing for certain drug-related crimes, and allow for more drug treatment programs, HB 353, was heard by the Judiciary Committee February 22, with no report. See RSC 3.
